HOUSING DISREPAIR

What Is Housing Disrepair?

If you rent your home, your landlord is legally obligated to repair the property and ensure safe living conditions. If you have asked your landlord to repair your home and they have refused, you may be eligible for housing disrepair compensation, and you can get a court order forcing the landlord to do repairs.

Legally, your landlord is required by law to ensure that your home is in good structural repair, there is no rising damp and mould in the property, you have access to safe electricity, water, and gas, you have working hygiene facilities such as sinks, toilets, and basins, the home is free from vermin and infestations, you have a working heating system, the roof is intact and safe, and the drains and gutters are working correctly.

If any of these factors are not functioning correctly, you may be eligible to claim compensation and force your landlord to carry out repairs. Unfortunately, many renters in the UK are not fully aware of their legal rights and are not aware if they have a disrepair claim.

You don’t have to use a claims management company to make a claim you can complain directly to your landlord for free, and if not successful, you may be able to make a claim using the Housing Ombudsman Service.

A disrepair house claim occurs when the tenant has reported an issue to the landlord and has given them sufficient time to carry out the repairs and has failed to carry out the required repairs or ignored you completely. You can take legal action against the landlord to ensure you make them fix the disrepair and potentially pay you compensation for your trouble.

There are various types of housing disrepair we have seen over the years, including claims for dampness and mould, unsafe flooring and staircases, faulty electrics, gas and water leaks, faulty or unsafe heating systems, rat, mice and insect infestations and issues with other parts of the home like broken fences, gates, and loose tiles and brickwork.

No, there are laws in place protecting tenants from being evicted for starting a housing disrepair compensation claim against their landlord. Under Section 11 of the Landlord and Tenant Act (1985) landlords are legally obligated to keep the property in a good state of repair.  It is their legal responsibility to act in your best interests.

Making a disrepair claim with the MoneyCornershop is relatively simple. You only need to get in touch with our team and provide a few details to help determine if you’re eligible. To lodge a successful claim you will need to provide some evidence such as a copy of your tenancy agreement, copies of your correspondence between you and your landlord in the form of texts, emails, or letters, photos of the disrepair if possible, photos of your damaged personal property with receipts if you’ve had replace some items, and any other expert evidence that will facilitate a successful disrepair claim.

You can provide Texts, emails or phone records. Your housing file may also contain recorded complaints as landlords are legally required to document them.

You need to notify your landlord about the disrepair as soon as you discover your disrepair. Otherwise, you will not be able to make a claim. You are required to notify your landlord via email, text message, letter or in person. However, we encourage you to record the conversation if you need to file a claim. The landlord has a minimum of 21 days to respond before you can file a housing disrepair claim.

Every housing disrepair claim is different, and the settlement varies depending on severity. We cannot determine how much you may be entitled to until you contact our experts. However, we can detail what damages you can seek to give you a clear idea of how much you can claim. These include damage to personal property due to the disrepair, and general inconvenience and suffering.

For a housing disrepair claim, you don’t have to worry about paying anything upfront. In the event that your claim is successful, a fee will be charged. The solicitor we appoint to your case will charge a success fee that will be 30% inclusive of VAT of your compensation. Should you cancel outside of the cooling off period, a termination fee may be charged, this is based on time spent on your claim, or if your case does not proceed because you do not cooperate fully with your solicitor by, for example, deliberately misleading your solicitor, failing to attend a court hearing, or not allowing an expert examination of the disrepair.
